Website Design & Development Deposit and Refund Policy
Effective date: March 10, 2026
SkyPoint Studios provides custom website design and development services. Each project requires professional time, planning, design, development, and coordination. This policy explains how payment constitutes acceptance, when deposits become nonrefundable, and how revisions and cancellations are handled.
By paying a project deposit after this policy has been presented to you, you agree to its terms. Your deposit becomes earned and nonrefundable upon delivery of a qualifying initial prototype, subject to the exceptions below and applicable law. No separate signature is required.
1. Acceptance by Payment
This policy forms part of your project agreement when it is provided to you before payment, together with notice that payment constitutes acceptance.
By paying the deposit, you accept this policy and authorize SkyPoint Studios to begin the services described in your proposal, invoice, or project scope. If you are purchasing on behalf of a business, you represent that you have authority to accept these terms for that business.
Your accepted proposal, invoice, and written project scope identify the services, pricing, deposit amount, and initial prototype deliverables. Any expressly agreed project-specific terms control over conflicting provisions in this policy.
2. Purpose of the Deposit
Your deposit is credited toward the total project price and pays for the initial project phase described in your project scope. This may include consultation, research, planning, project setup, design, development, and preparation and delivery of the initial prototype.
The deposit compensates SkyPoint Studios for professional services performed. It is not a refundable trial or payment contingent solely on approval or publication of the completed website.
3. What Constitutes a Qualifying Initial Prototype
A qualifying initial prototype is a substantive, project-specific website design or working preview that materially addresses the initial prototype deliverables described in your project scope.
Depending on the agreed deliverables, the prototype may be a homepage design, design mockup, staging website, or other agreed preview demonstrating the proposed layout, visual direction, and relevant functionality.
An initial prototype is provided for review and refinement. It may include placeholder text or images, incomplete secondary pages, or features scheduled for a later project phase. Unless expressly included in the initial milestone, the entire website does not need to be complete or ready for publication.
A generic template, placeholder page, or inaccessible preview alone does not qualify as delivery of the initial prototype.
4. Prototype Delivery
Delivery occurs when SkyPoint Studios sends the qualifying initial prototype, or working access instructions, to your designated email address or agreed project communication platform and makes it reasonably available for review.
If you cannot access the prototype, notify us promptly so we can resolve the issue. An inaccessible preview does not complete the delivery milestone until working access is provided.
Delivery does not require your approval, use of the prototype, or authorization to publish. Your decision not to review an accessible prototype does not reverse delivery.
5. Nonrefundable Deposit After Prototype Delivery
Upon delivery of a qualifying initial prototype, your deposit becomes earned and nonrefundable as payment for the agreed initial project phase.
After this milestone, a change of mind, decision to discontinue the project, preference for another provider, or request for a different design direction does not by itself create a right to a deposit refund.
An initial design may require revisions. Dissatisfaction with aesthetic choices does not, by itself, mean that services were not provided or that the deposit must be returned.
This provision remains subject to Section 10 and applicable law. It does not excuse a material failure by SkyPoint Studios to perform its contractual obligations.
6. Revisions and Our Commitment to Your Project
SkyPoint Studios will work with you in good faith to refine the website and address specific feedback through the revisions included in your project scope.
Please provide clear, consolidated feedback identifying the changes you want. Requests should be evaluated against the agreed scope and design direction.
Corrections necessary to bring our work into conformity with the agreed scope are our responsibility. Additional concepts, expanded functionality, new pages, or substantial changes to an approved direction may require an additional fee and revised schedule.
We will obtain your approval before undertaking additional billable work. Our commitment to customer satisfaction does not create an obligation to provide unlimited revisions, repeated complete redesigns, or services outside the agreed scope without compensation.
7. Project Timelines and Redesigns
Project timelines are estimates unless a firm deadline is expressly agreed in writing. Timely completion depends on customer feedback, content, credentials, approvals, and any required third-party services.
Delivery of an initial prototype is separate from completion and publication of the finished website.
A substantial redesign or change in scope requires an updated schedule agreed in writing. It is not automatically due within the original project’s remaining timeframe.
We will communicate material delays and proposed schedule changes. Nothing in this section excuses failure to meet an expressly agreed material deadline.
8. Third-Party Services and Expenses
Projects may require MLS/IDX services, domains, hosting, software licenses, stock assets, or other third-party purchases.
Before incurring separately chargeable third-party expenses, we will obtain your authorization and disclose any known nonrefundable commitment. Authorized expenses already incurred and not recoverable from the provider remain payable to the extent permitted by law and your project agreement.
Any third-party credits or refunds recovered for your project will be reflected in the final accounting. Expenses already covered by your deposit will not be charged a second time.
9. Cancellation
You may request cancellation in writing using the contact information on your proposal or invoice.
Before prototype delivery: We will account for services actually performed and authorized nonrecoverable expenses using the pricing or cancellation method disclosed and accepted before payment. Any remaining unearned portion of the deposit will be refunded.
After prototype delivery: The earned deposit remains nonrefundable, subject to Section 10 and applicable law. Cancellation does not undo services already performed or delivery of the initial prototype.
Cancellation does not automatically make the full unpaid project balance due. Additional amounts are payable only for authorized work or commitments under your project agreement. No service or expense will be charged twice.
If SkyPoint Studios ends a project before completing the applicable paid services, we will provide an accounting and refund any unearned amount required by the project agreement or applicable law.
10. Nonperformance and Required Refunds
This policy does not authorize SkyPoint Studios to retain payment where a refund is required because of our material nonperformance, applicable law, or an expressly agreed contractual obligation.
If you believe a deliverable materially fails to meet the agreed scope, please notify us in writing and identify the specific deficiencies. Where appropriate and legally permitted, we request a reasonable opportunity to correct them.
Nothing in this policy excludes nonwaivable consumer protections, remedies for material breach, or rights concerning unauthorized payments.
11. Billing Questions and Payment Disputes
Please contact SkyPoint Studios promptly with billing concerns so we can review the project record and work toward a resolution.
If a payment dispute occurs, we may provide relevant records to the payment processor, card network, or issuing bank. These may include the policy presented before payment, the invoice and project scope, payment records, prototype delivery evidence, project communications, and records of services performed.
This policy does not waive lawful payment-dispute rights or require a payment processor, card network, or issuing bank to decide a dispute in our favor.
12. Policy Versions and Existing Projects
The version presented to you before payment governs your project unless both parties subsequently agree to a change.
Later updates to this page do not automatically alter existing agreements or apply retroactively to earlier payments.
If any provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
